Terms of Service

These Terms govern the relationship between you and Variable Geometries Ltd ("Variable Geometries" thereafter), registered in England and Wales (company number 11350103), with its registered office located at International House, 64 Nile Street, London N1 7SR, United Kingdom.

By accepting these Terms you accept to be bound by them in relation to any use of the LockOnMe application, the corresponding lockonme.com & lockon.me websites (the aforementioned application and websites collectively referred to as "Services" thereafter), and any information contained therein and in respect of any ensuing or related contract or non-contractual obligation arising therefrom.
Please read these Terms carefully before using the Services.
These terms (and any non-contractual obligations arising therefrom) are governed by English law and the English courts shall irrevocably have exclusive jurisdiction.


1. Privacy Policy

2. Security

You must be at least 13 years of age to use the application and related services.

WARNING: DO NOT GIVE OUT PERSONAL INFORMATION. DO SO AT YOUR OWN RISK; Variable Geometries CANNOT BE HELD LIABLE FOR ANY DAMAGE OR INJURY CAUSED BY DISCLOSING PERSONAL INFORMATION SUCH AS THE TRACKING DETAILS USED TO LOCATE THE USER.
Do not provide your tracking code indiscriminately or publicly, as this could lead to harmful situations.

You shall not use the Services for any unlawful or unauthorised purpose. You are responsible for all statements made and acts or omissions that occur while your user identification name ("User ID"), password or tracking code are being used. By accepting these terms, you warrant that you are authorised to bind the company or firm to which your User Name has been issued and you accept that you are responsible for protecting and securing your User Name, password and tracking code from unauthorised use and disclosure and that any unauthorised use shall not affect the binding nature of any such communications. If you become aware of, or believe there has been, any breach of security for any of your information, such as the theft or unauthorised use of your User ID, password, tracking code or any other information, you will notify Variable Geometries immediately. Any offer or other communication made using your User Name shall be deemed to be your act and Variable Geometries shall be entitled to rely on the same without restriction whether or not any such offer or other communication was made by you.



3. Disclaimers & No Warranty

Variable Geometries does not give any warranty as to the accuracy, completeness, timeliness, integrity or fitness for purpose of the service provided. By accepting these terms, you expressly disclaim all warranties of any kind, express or implied, including without limitation any warranty of merchantability, noninfringement or fitness for a particular purpose and you agree that errors and/or omissions contained in such information or any delay (whether caused by delay in internet connection, update or otherwise) shall not be made the basis for any claim, demand or cause of action against Variable Geometries or the provider hosting the location database.

In particular, the service is not intended to address critical positioning requirements, especially when life and death are at stake (e.g. emergency location service), although it may prove useful.

YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES AND ANY DATA, INFORMATION, THIRD-PARTY SOFTWARE, MEMBER CONTENT, WEBSITES, OR APPLICATIONS MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE", "WITH ALL FAULTS" BASIS AND WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND EITHER EXPRESS OR IMPLIED.

Variable Geometries and its suppliers DO NOT WARRANT THAT THE DATA, FUNCTIONS OR ANY OTHER INFORMATION OFFERED ON OR THROUGH THE SERVICE OR ANY THIRD PARTY SITES WILL BE UNINTERRUPTED, OR FREE OF ERRORS, VIRUSES OR OTHER HARMFUL COMPONENTS AND DO NOT WARRANT THAT ANY OF THE FOREGOING WILL BE CORRECTED.

Your location and location of your targets and various contacts is determined by the mobile devices themselves, with the application merely interpreting and displaying that information.
Variable Geometries and its suppliers DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICE OR ANY THIRD PARTY SITES IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY OR OTHERWISE.



4. Limitation of Liability and Damages

Variable Geometries shall not in any circumstance be liable for any loss, damage or injury of whatsoever nature suffered or incurred directly or indirectly by you, arising from the use of the Services.



5. No Advice

Any advice that may be provided in the Services is for informational purposes only and is not intended to replace or substitute the advice of a professional. Variable Geometries makes no representations or warranties and expressly disclaims any and all liability concerning any treatment, action by, or effect on any person following the information offered or provided within or through the Services. If you have specific concerns or a situation arises in which you require professional advice, you should consult with an appropriately trained and qualified specialist.



6. Restrictions

You may not exploit images or sounds provided as part of the Services for your own commercial use or that of a third party without prior approval from Variable Geometries.



7. Limited Licence/Copyright

Subject to the present terms and conditions, Variable Geometries grants you a non-exclusive, non-transferable, limited right to access, use and display the LockOnMe application and related websites, and the materials thereon.
LockOnMe is free for use in any environment, including but not necessarily limited to: personal, academic, commercial, government, business, non-profit, and for-profit. "Free" in the preceding sentence means that there is no cost or charge associated with the use of LockOnMe.
You may not otherwise copy, reproduce, recompile, decompile, disassemble, reverse engineer, modify, distribute, publish, display, perform, create derivative works from, transmit or in any way exploit any part of the application and websites.
All proprietary rights remain the property of Variable Geometries. The Services and all included content (such as graphics, logos, icons, text, sounds and images) is copyrighted and protected by worldwide copyright laws and treaty provisions. You agree to comply with all copyright laws worldwide in your use of the Services.
All sound effects and music tracks retain the copyright of their original owners at all times.

8. User content

The Services may allow users to post, link, share or otherwise make available certain text, graphics, videos or other materials ("User Content"). You are solely responsible for all User Content you post, including its legality, reliability and appropriateness according to these Terms. By posting User Content on our Site, you represent and warrant that:

  1. you own the User Content or have the right to use it and grant us the rights and license as provided in these Terms;
  2. the postings of your User Content on or through the Site does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Variable Geometries reserves all rights to block or remove any User Content made available as part of the Services that we determine to be:
  1. abusive, defamatory, or obscene;
  2. fraudulent, deceptive, or misleading;
  3. in violation of a copyright, trademark, or other intellectual property right of another;
  4. offensive or otherwise unacceptable, in our sole discretion.

By posting User Content, you grant Variable Geometries the right and license to use, modify, publicly perform, display, reproduce and distribute such User Content on and through the Services. You retain any and all of your rights to any User Content you submit and are responsible for protecting those rights.



9. Idea Submission Policy

Variable Geometries may, from time to time, accept or consider user feedback or ideas, including, without limitation, ideas or suggestions for new or improved features on the Service (collectively "Ideas"). If You choose to submit your Ideas to us or to any of our employees and/or contractors, then you hereby grant us and our designees a worldwide, non-exclusive, sublicenseable (through multiple tiers), assignable, royalty-free, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), create derivative works of, publicly perform, publicly display and license, digitally perform, make, have made, sell, offer for sale and import Your Ideas, including, without limitation, all copyrights, trademarks, trade secrets, patents, industrial rights and all other intellectual and proprietary rights related thereto, in any media now known or hereafter developed, for any purpose whatsoever, commercial or otherwise, including, without limitation, giving the Ideas to others. In the event that Variable Geometries incorporates your Ideas or adopts a feature, product or strategy that may be similar, You acknowledge that You shall not make any claims against Variable Geometries in connection therewith, and shall fully indemnify Variable Geometries if, despite Your agreement not to pursue any claims against Variable Geometries, You choose to do so. Please remember that You have no obligation to submit any ideas to Variable Geometries and, if You do submit anything to us, You have no expectation of credit or compensation of any kind.



10. Modification of these Terms and Services

Variable Geometries reserves the right, at our discretion, to change, modify, add, suspend, terminate or remove portions of these Terms of Services at any time, with or without notification.
Variable Geometries reserves the right to make changes to the Services at any given time, to charge for Services or for particular features, and to modify any fees or Services.
By accepting these terms you agree to be bound by all changes expressed above.
If you do not agree with the present or updated terms, amended from time to time, do not use the Services and/or any related application.
